User Agreement & Refund Policy

1. Introduction

Welcome to Jaywan Inc. (“Company,” “we,” “our,” or “us”). By purchasing or ordering any of our music promotion, marketing, distribution, or related digital services (“Services”), you (“Client,” “User,” or “Customer”) agree to be bound by this Refund Policy & User Agreement (“Agreement”).

Please read this Agreement carefully before submitting any order or payment. Your use of our Services constitutes your full acceptance of these terms.


2. All Sales Are Final

All payments made to Jaywan Inc. for any promotional, marketing, advertising, or digital distribution services are non-refundable and final.

Due to the digital and customized nature of our work — which begins processing immediately upon order — we cannot offer refunds, credits, or exchanges once an order is placed.

By completing your purchase, you acknowledge and agree that:

    • You have reviewed all service descriptions prior to purchase.
    • You understand that all sales are final at the point of payment.
    • You will not dispute, charge back, or request refunds through your financial institution or payment processor for any reason.

3. Service Delivery

Jaywan Inc. provides promotional services that are customized and executed according to the details provided by the client. Timelines for completion may vary depending on the service type, campaign size, and third-party platforms involved.

We strive to deliver all services within the stated timeframes, but Jaywan Inc. does not guarantee specific results, placements, engagement metrics, or audience response, as these outcomes depend on numerous external factors beyond our control.


4. Client Responsibilities

By ordering a service, you agree to:

    • Provide accurate and complete information necessary to deliver your campaign (such as music links, artwork, press materials, etc.).
    • Ensure that you hold all rights, licenses, and permissions to the materials you submit.
    • Refrain from submitting any content that is unlawful, misleading, defamatory, or infringing on third-party rights.

Jaywan Inc. reserves the right to refuse or terminate any campaign that violates these terms, without refund.


5. No Guarantee of Results

While Jaywan Inc. uses its best professional efforts to promote your music or project, you understand and agree that:

    • We do not guarantee chart placements, radio spins, playlist adds, press coverage, or follower growth.
    • Marketing results vary per artist, budget, and campaign scope.
    • Any examples of success or past results shared by Jaywan Inc. are illustrative only and not a promise or guarantee of future performance.

6. Cancellations

Because all services begin processing immediately upon payment, orders cannot be canceled once placed.

If a campaign is delayed or modified due to client failure to provide necessary materials or respond to communications, Jaywan Inc. reserves the right to mark the service as “completed” after a reasonable period of inactivity (typically 14 days).


7. Limitation of Liability

To the fullest extent permitted by law, Jaywan Inc. and its affiliates, directors, agents, or employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of:

    • The use or inability to use our Services;
    • Delays or errors in service delivery;
    • Third-party actions, including but not limited to media outlets, social platforms, or streaming services.

Jaywan Inc.’s total liability under any circumstance shall not exceed the total amount paid by the client for the specific service in question.


8. Dispute Resolution

Any disputes arising under this Agreement shall first be attempted to be resolved through good-faith communication between the parties. If unresolved, disputes shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

You agree to submit to the exclusive jurisdiction of the courts located in Florida for the resolution of any disputes related to this Agreement or your use of Jaywan Inc.’s Services.


9. Changes to Policy

Jaywan Inc. reserves the right to modify, amend, or update this Refund Policy & User Agreement at any time without prior notice. The latest version will always be available on our website, and continued use of our Services after any changes constitutes your acceptance of the updated terms.
